As you know, tort reform in South Carolina has been much needed for years. The current legal climate presents significant challenges for insurers, businesses, and consumers alike due to the loopholes in the current law that can hold a business unfairly accountable.
Tort reform is done for 2025. Bill H. 3430 was signed into law by Gov. McMaster on May 13, 2025. Modifications were made to joint & several liability, liquor liability requirements, insurance reporting requirements, captive insurance, risk mitigation programs and repercussions for DUI drivers. Effective date is Jan. 1, 2026.
